Terms and Conditions

§ 1 General Provisions

1.) These Terms and Conditions govern the relationship between the user and the provider (hereinafter referred to as the "Provider") in connection with the use of the game and all related services. These conditions form the basis of the usage agreement and are prepared in accordance with Hong Kong laws, including the Electronic Transactions Ordinance (Cap. 553), Unconscionable Contracts Ordinance (Cap. 458), Personal Data (Privacy) Ordinance (Cap. 486), and others.

2.) The user enters into an agreement for the free use of the game by registering and logging into the game. By registering, the user confirms that:

2.1) They agree to these Terms and Conditions.

2.2) They have provided a valid email address, which is necessary for account verification and communication with the Provider.

3.) By logging into the game, the user confirms that they have read these Terms and Conditions and express their consent to their current version.

4.) The usage agreement is valid for an indefinite period and can be terminated by either party at any time by written notice, usually via email, without the need to adhere to a notice period.

5.) The user is not entitled to create an account, guarantee access to the game, or ensure its continuous availability.

6.) The Provider reserves the right to modify, improve, or terminate the operation of the game at any time without providing reasons.

7.) The game is only permitted for players over the age of 18.

8.) The user agrees to any modified Terms and Conditions by re-logging into the game after their publication. The user will be informed of all changes via in-game announcements, Facebook, or Discord. By continuing to use the game, the user confirms their agreement with the current version of the Terms and Conditions.

§ 2 Virtual Property and User Accounts

1.) Ownership of Virtual Property:

1.1) All account content, including virtual coins, items, characters, and other values associated with the account, is the property of the Provider.

1.2) The user acquires an exclusive right to use their account and a non-exclusive right to use all virtual properties within the game. These rights are time-limited to the duration of the agreement unless otherwise specified in the game.

2.) Prohibited Activities:

2.1) It is strictly forbidden to sell game accounts for real money, yang, coins, or other forms of compensation, whether within or outside the game.

2.2) It is prohibited to sell game items or characters for real money or other real values. However, trading game items or characters for yang, coins, or other in-game values is permitted only within the game’s rules.

2.3) Exchanging virtual property for values outside the scope of the game rules is prohibited.

3.) User Responsibility:

3.1) Each user is responsible for securing their login credentials and should choose a secure and unique password.

3.2) The Provider is not responsible for the loss of virtual property caused by insufficient account security on the part of the user.

3.) Validity of Email Address:

3.1) The user must ensure that the provided email address is valid and that they are entitled to use it. If the email address is not valid, the Provider reserves the right to block or delete the account.:

3.2) The Provider is not responsible for damages caused by the use of an email address to which the user does not have rights.

4.) The Provider reserves the right to delete accounts that have been inactive for a reasonable period to ensure efficient management of game resources.

5.) The user does not acquire ownership or other rights to virtual property, even if such property is purchased with real money through the Item-Shop.

§ 3 Exploitation of Errors and Scripts/Cheating

1.) Users are required to follow the game rules and not exploit any errors, scripts, hacks, or other unauthorized means that could disrupt the course of the game or provide unauthorized advantages.

2.) Any behavior that violates the integrity of the game may result in immediate action by the Provider, including blocking or removing the account.

3.) Prohibition of Automated Tools:

3.1) The use of automated or semi-automated tools, such as bots, macros, scripts, or other mechanisms that manipulate game systems, automate gameplay, or perform database queries, is strictly prohibited.

3.2) This prohibition includes any tools that simulate human interaction to gain advantages over other players.

4.) Exploitation of Errors and Exploits:

4.1) Users must not intentionally search for, exploit, or share information about game errors (exploits) that could disrupt the game balance.

4.2) If a user discovers an error or another issue in the game system, they are required to promptly inform the support team.

5.) Consequences of Rule Violations:

5.1) In the event of a breach of these provisions, the relevant account may be immediately blocked or deleted without prior notice.

5.2) The Provider reserves the right to claim compensation for damages caused by the rule violation, including administrative costs related to investigations and damage repair.

5.3) In the case of widespread abuse, the Provider may take additional measures, such as temporarily suspending the game or resetting game data.

6.) Compliance with Hong Kong Law:

6.1) This provision complies with the Prevention of Computer Crimes Ordinance (Cap. 200) and other Hong Kong laws regulating cybercrime.

6.2) Any attempts at unauthorized access to the database, manipulation of game servers, or exploitation of errors may be reported to relevant law enforcement authorities.

7.) Users are fully responsible for their behavior in the game. If rules are violated due to account sharing with others, the account owner is liable for the consequences.

8.) The Provider reserves the right to monitor in-game activity to detect unauthorized activities.

§ 4 Rules of Conduct

1.) Prohibition of Advertising Foreign Products and Services:

1.1) Users may not advertise products, services, websites, or third-party companies in any way unless they have explicit permission from the Provider. This prohibition includes but is not limited to:

- Posting links to external websites.

- Distributing promotional messages, offers, or advertising materials.

- Any form of unsolicited advertising (spam) within the gaming environment.

2.) Creating Inappropriate Content:

2.1) User-generated content that:

- Violates applicable laws, especially the Control of Obscene and Indecent Articles Ordinance (Cap. 390),

- Damages human dignity, contains offensive, discriminatory, or hateful expressions,

- Violates the ethical norms of the gaming community,

may be modified or removed without prior notice.

3.) Account Blocking and Deletion:

3.1) User accounts that repeatedly create or share content violating these rules may be blocked or deleted.

3.2) The Provider reserves the right to take further actions, including limiting access to certain game functions or services.

4.) Prohibited Behavior in the Game:

4.1) Impersonate other players, members of the game team, administrators, or support staff.

4.2) Spread false information that could disrupt the gaming community.

4.2) Threaten other players or share content promoting violence or illegal activities.

5.) Compliance with Hong Kong Law:

5.1) This provision complies with the Race Discrimination Ordinance (Cap. 602), Disability Discrimination Ordinance (Cap. 487), and other Hong Kong laws regulating equality, respect, and protection against discrimination.

5.2) Content violating local legal regulations may be reported to relevant authorities for further investigation.

6.) User Responsibility:

6.1) Users are responsible for all content they share within the gaming environment and bear the consequences of any rule violations.

6.2) In case of disputes or complaints about inappropriate behavior, the Provider is authorized to act based on available evidence.

7.) The Provider reserves the right to conduct regular checks of user-generated content to ensure compliance with game rules and legal regulations.

8.) Users are encouraged to adhere to the principles of fair play, mutual respect, and to contribute to creating a positive gaming environment for all community members.

§ 6 Liability and Limitation of Liability

1.) The Provider is not responsible for the loss of virtual property, game outages, or damages caused by technical issues.

2.) The user acknowledges that they play at their own risk, and the Provider does not guarantee uninterrupted availability of services.

2.) The Provider does not warrant that the game will be error-free, uninterrupted, or secure, and excludes any express or implied warranties to the extent permitted by law.

3.) To the fullest extent permitted by law, the Provider’s liability for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the game, including damages for loss of data or other losses, is limited.

4.) This limitation is in accordance with the Unconscionable Contracts Ordinance (Cap. 458), which ensures that no unfair terms are imposed on users.

§ 7 Dispute Resolution and Arbitration Clause

1.) All disputes shall primarily be resolved through mediation. If mediation fails, they shall be resolved through arbitration under the Hong Kong Arbitration Ordinance (Cap. 609).

2.) The place of arbitration shall be the Hong Kong International Arbitration Centre (HKIAC).

§ 8 Anti-Money Laundering Compliance

1.) All transactions are subject to the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615).

2.) The Provider reserves the right to verify the user’s identity for transactions exceeding limits set by Hong Kong law.

3.) Suspicious activities will be promptly reported to the relevant authorities in accordance with applicable laws.

§ 9 Copyright and Intellectual Property Rights

1.) Ownership of Rights:

1.1) All rights to the software, websites, graphic content, audiovisual elements, source codes, texts, logos, trademarks, and any other related materials are the exclusive property of Mt2Factory Limited.

1.2) Any reproduction, distribution, public dissemination, modification, or other use of these materials without the express written consent of Mt2Factory Limited is strictly prohibited.

2.) Legal Protection:

2.1) All rights are protected under Hong Kong laws, including:

- Copyright Ordinance (Cap. 528) – Protection of copyright and intellectual property.

- Trade Marks Ordinance (Cap. 559) – Protection of registered trademarks and their use.

- Designs Ordinance (Cap. 522) – Protection of unique designs and graphic elements of games and websites.

3.) Prohibition of Unauthorized Use:

3.1) Users are prohibited from:

- Copying, modifying, decompiling, or reverse-engineering the software or its components.

- Using software materials, including graphics, sounds, or texts, for personal or commercial purposes without prior written approval from the Provider.

4.) Liability for Breach of Rights:

4.1) Any unauthorized use or violation of intellectual property rights may result in:

- Immediate blocking of the user’s account.

- Filing a claim for damages in accordance with Hong Kong legal regulations.

- Criminal prosecution under Hong Kong laws protecting intellectual property.

5.) Monitoring and Enforcement:

5.1) Mt2Factory Limited reserves the right to monitor the use of its products and services to detect unauthorized usage.

5.2) Any detected violations will be addressed promptly, including potential involvement of relevant legal and administrative authorities in Hong Kong.

6.) Licensing for Users:

6.1) Users are granted a non-exclusive, non-transferable license to use software and services solely for personal, non-commercial purposes.

6.2) This license is time-limited to the validity of the user’s account and cannot be transferred to another person.

7.) Any activity that infringes upon the rights of the Provider or third parties will be evaluated under Hong Kong laws and may be reported to relevant authorities, such as the Hong Kong Intellectual Property Department (IPD).

8.) Users who identify any unauthorized use of game materials or other related rights are obligated to report such issues promptly to Mt2Factory Limited through official communication channels.

§ 10 Refund Policy

1.) Finality of Purchases:

1.1) All purchases of virtual coins and game items are considered final and non-refundable.

2.) Use of Virtual Coins:

2.2) Virtual coins are credited to the user's account in the game’s Item-Shop immediately upon purchase. Coins are deemed consumed when the user utilizes them to purchase specific game items or services in the Item-Shop. After this transaction, no refund for consumed coins is possible.

3.) Errors in Transactions:

3.3) The Provider is not responsible for errors caused by the user during the purchase process, such as incorrect information.

4.) Refunds may be granted only in the case of technical errors caused by the Provider, subject to individual assessment.

5.) The user acknowledges that the purchase of virtual items does not fall under consumer protection laws applicable to physical goods.

§ 11 Privacy Policy

1.) By accepting these Terms and Conditions, the user agrees to the processing of their personal data as described below:

a) Email Address:

- Required for account confirmation, security, and recovery (e.g., in case of password loss or data changes).

- Used for sending newsletters and important game-related announcements.

b) Username:

- The username is a public identifier visible to other players and is not considered personal data.

c) IP Address:

- IP addresses are logged for account security and rule enforcement. In case of rule violations, accounts can be linked by IP address.

- Players can activate IP security (Czech - Ochrana na IP) to restrict account access from IP addresses that are not theirs.

d) Password:

- A password is required to access the account. Users are advised to create a unique and secure password to protect both their game account and other personal accounts.

- All passwords are securely hashed and are not visible even to the Provider.

2.) Personal data is processed in compliance with the Personal Data (Privacy) Ordinance (Cap. 486) and stored securely to prevent unauthorized access.

3.) Personal data is used solely for ensuring account security, game operations, and communication between the user and the Provider.

4.) Personal data will not be shared with third parties unless required by law or system security needs.

§ 12 Data Retention and Deletion (Personal Data (Privacy) Ordinance)

1.) Retention Period:

1.1) The Provider will retain personal data for as long as necessary to fulfill the purpose for which it was collected or as required by applicable law.

1.2) After the retention period, personal data will be securely deleted or anonymized in accordance with the Personal Data (Privacy) Ordinance (Cap. 486).

2.) Users have the right to request the deletion of their personal data at any time. Such requests will be handled in accordance with the Personal Data (Privacy) Ordinance (Cap. 486), and deletion may be subject to any legal obligations for data reten

§ 13 Consumer Protection (Trade Descriptions Ordinance)

1.) Misleading Advertising:

1.1) The Provider will not engage in misleading or deceptive conduct, and all advertising materials regarding the game and its services will comply with the Trade Descriptions Ordinance (Cap. 362).

1.2) Any representations made by the Provider will be truthful and not intended to mislead or deceive consumers.

2.) In accordance with the Trade Descriptions Ordinance (Cap. 362), users are entitled to certain rights regarding goods and services. However, as virtual goods are non-physical items, the refund policy is governed by the specific terms in this agreement.

§ 14 Health and Safety

1.) Health Considerations:

1.1) The Provider acknowledges the potential health implications of prolonged gaming and encourages players to take breaks and engage in healthy gaming practices.

1.2) The Provider will not be held responsible for any health issues caused by excessive use of the game, as it is the responsibility of the user to manage their gaming time.

2.) The Provider will include health and safety warnings in the game where necessary to remind users of the risks associated with excessive screen time, in accordance with the Occupational Safety and Health Ordinance (Cap. 509).

§ 15 E-Commerce and Electronic Transactions

1.) Electronic Contracts:

1.1) The Provider acknowledges the validity of electronic contracts as stipulated in the Electronic Transactions Ordinance (Cap. 553). By registering, making purchases, or using services within the game, users enter into legally binding electronic agreements with the Provider.

1.2) The Provider ensures that all transactions conducted through the game’s platform are secure and comply with the standards set by the Electronic Transactions Ordinance (Cap. 553).

2.) The Provider is committed to protecting users personal data and transactions in accordance with the Electronic Transactions Ordinance (Cap. 553). All transactions are conducted using secure methods, ensuring that sensitive information, including payment details, is not exposed to unauthorized parties.

Governing Law:

This document is prepared in accordance with Hong Kong law and shall be governed and interpreted accordingly.
